Georgian law about the amendments and additions in some Legislative Acts of Georgia

 

The Parliament of Georgia establishes:

The law of Georgia “about the support and guarantee of the investment activity” (Georgian Parliament Announcements, N 29-30/5, Dec. 11, 1996) shall be amended and added as follows:

The first paragraph of the Article 9 shall be added the “h” sub-paragraph:

“h) In the import and realization of motor petrol containing lead (more than 0.013 gram per liter), tetralead, also falsified (non-standard) public utility use liquid gas. (The investment of the tetralead in the import is allowed only in necessary cases, which are permitted by the technology of production)”.

The first passage of the Article 17 shall be considered the first paragraph, also the 2nd-4th paragraphs shall be added to the same article:

“2. Before the enactment of the “h” sub-paragraph of the first paragraph of the Article 9 of this law, the State Committee for Environment and Natural Resource Protection at the Parliament of Georgia and the Committee of Different Economical Issues shall provide the control and coordination on elaboration and implementation of preparatory measures.

The elaboration and the implementation of preparatory measures shall be the responsibility of the Ministries of Fuel and Energy, Environment and Natural Resource Protection, International Affairs and Economy, also the State Department of Customs of Georgia and “Sakstandart”. “Sakstandart” shall elaborate the proper standards for public utility use liquid gas until Sep. 1st, 1999.

“Sakstandart” and the other State Management authorized organs within the competence defined by the law shall provide the implementation of the demands of the “h” subparagraph of the first paragraph of the Article 9 of this law.

Georgian Code of the Administrative Violations of Law (The Announcements of the Highest Council of the Soviet Republic of Georgia N 12, 1984, Article 421) shall be added the following:

The Code shall be added the following Article 91²:

“Article 91². The import or realization of lead containing motor petrol (not more than 0,013 gram per liter), tetralead, also falsified public utility use liquid gas on the territory of Georgia

The import or realization of lead containing motor petrol (not more than 0,013 gram per liter), tetralead, also falsified public utility use liquid gas on the territory of Georgia-shall be fined the minimum of daily payment from ten to one hundred entities with the confiscation of the production”.

The Article 239 shall be added the following 29-th part:

“The Act for The Administrative Violations of Law provided by the Article 91² defines “Sakstandart”, also the bodies of Internal Affairs (Ecopolice), Environmental Protection and Customs on the basis of the conclusion of law authorized bodies”.

Georgian Criminal Code (The Announcements of the Highest Council of Georgia, 1961, Article 10) shall be added the following Article 172¹:

“Article 172¹. The import or realization of lead containing motor petrol (not more than 0,013 gram per liter), tetralead, also falsified public utility use liquid gas on the territory of Georgia

The import or realization of lead containing motor petrol (not more than 0,013 gram per liter), tetralead, also falsified public utility use liquid gas on the territory of Georgia, after the use of measures of administrative influence the commitment is punished by the imprisonment up to one year.

The import or realization of lead containing motor petrol (not more than 0,013 gram per liter), tetralead, also falsified public utility use liquid gas in large amounts on the territory of Georgia shall be punished by the imprisonment from one to two years.

If the action, defined in the second part of this article is committed repeatedly by the group of persons or in the other aggravating circumstances shall be punished by the imprisonment from two to four years.

Comment: Under the large amount provided by this Article more than 30 tones of motor petrol and liquid gas, also more than 10 liters of tetralead are considered”.

This law shall be enacted from the first of January, 2000, but the 1st and the 2nd passages of the 2nd paragraph of the Article 1 immediately after publishing.

This law has many drawbacks. One and the important is that it does not speak about export and local production at all. It is very strange to have such big gap, especially in the amendment.
